Retraining Order Granted to JAMIE

Well as you all may know, Britney’s team have been trying to get permanent restraining orders against Osama Lutfi, Britney’s ex-manager, and Jon Eardley, the attorney Britney left voice messages for in January asking for his help. Well the courts granted the Spears’ wishes on Tuesday 28 April.

Los Angeles Superior Court Judge Aviva K. Bobb ruled that both men had to keep at least a 100 feet distance from Brit’s home, work, car or family until April 28, 2012. A similar order was placed on Adnan Ghalib, Brit’s ex boyfriend, last month. He is currently also being sued by a process server who he ran over with his car in an attempt to escape being served the papers. To view the legal papers courtesy of E! Online, click here.

As happy as I’m sure Daddy Spears is that all this has happened, I wonder if he saw what’s came next. Just one day after the ruling, Sam Lutfi has filed an appeal challenging the ruling.

Lutfi’s attorney, Bryan Freedman, explains to E! News:
“There was absolutely no evidence whatsoever that Britney Spears was suffering substantial emotional distress as required by the statute. In fact, the evidence was just the opposite—it was that she was reaching out for Sam's help, and all Sam did was get her a lawyer. There is no evidence of threats or stalking or anything whatsoever. We believe the appellate court will overturn the ruling. Restraining orders were created for stalkers and for people who make threats, and truly the only evidence that existed in the whole case was that Sam sent 10 text messages to the hairdresser—none of which were threatening or a vulgar word or mean or anything else.”

Freedman continued to explain how his client was simply looking out for Spears best interests, and how he does not believe Britney wants the order at all:
“Sam got her a lawyer, and facilitated his sister, and she requested getting her a cell phone. If Britney Spears wanted this restraining order herself then why didn't she testify, come to court, send a letter to the judge or do anything?”

This comes after a judge previously decided and ruled that Britney “lacks the capacity to testify” against Lutfi and Eardley.
